Ticketing Terms and Conditions – Atlético Dallas
I understand and agree that my rights under this Agreement are subject to, and I hereby expressly assent to, the Terms and Conditions of USL Dallas, LLC d/b/a Atlético Dallas (“Atlético” or “Club”) at https://www.atleticodallas.com/termsandconditions. In the event of any conflict between these Ticketing Terms and Conditions, these Ticketing Terms (together with the Recurring Payment Authorization and Membership Agreement Terms and Conditions, collectively the “Terms”) control over any conflicting website Terms of Use or platform terms with respect to Tickets, Membership, and Event attendance.
I understand that the Tickets will be delivered to me through my Jump account, the designated ticketing platform and secondary marketplace. Any attempt to deliver or resell Tickets outside of Jump’s platform, except as required by law or during a verified Jump platform outage, may result in cancellation or voiding of the affected Tickets, with notice to You and an opportunity to contest the action. If the violation was due to a platform outage or legal requirement, reinstatement of Tickets will be provided without penalty.
- TICKETS RESERVED: Atlético may, in its reasonable discretion, amend, update, and/or modify policies, prices, procedures and other terms and conditions relative to Your (as defined below) Membership, including this Agreement, to the individual or corporate entity name that appears on the Membership account of record (“You” or “Your”), which may be made by, but is not limited to, email or posting at www.atleticodallas.com. By accepting these Terms, You also agree to the Terms of Use and Privacy Policy posted at www.atleticodallas.com, which are incorporated herein by reference; in the event of a conflict, these ticket Terms will control for event attendance.
- ACCOUNT OWNERSHIP: You may not assign any of Your interest in this Agreement, including Your Membership, without the prior written consent of Atlético. The name associated with Your Membership account may not be changed, except as follows: legal name change, change in marital status, change in business name, death, or entity restructuring. All requests for Membership account information changes must be submitted to Atlético, in writing, accompanied by supporting legal documentation (such as marriage certificate, divorce decree, death certificate, or corporate documents) as applicable. Atlético will process such requests within 60 days of receipt of all required documentation.
- YOUR MEMBERSHIP IS A REVOCABLE LICENSE: Your Membership includes the Tickets, which, like all tickets sold for events at the Cotton Bowl, are owned by Atlético. Your Membership (and each included Ticket) is a revocable license issued by Atlético to You. Atlético may terminate Your Membership at any time upon written notice to You for any reason and, other than in the event of Your breach of this Agreement, in such event, Atlético will refund any pro rata portion of Your Membership dues as of the date of such termination. In the event of nonpayment, You will have 10 days from notice to cure before termination. Any material breach by You of this Agreement, including but not limited to nonpayment, violation of Venue rules, or unauthorized resale, shall entitle Atlético to all available legal remedies, including, but not limited to, revocation or cancellation of Your Membership, with no further compensation or refund. Upon such cancellation or revocation by Atlético, You shall forfeit all rights to purchase Playoff Tickets, except that if termination is not for breach, You will retain the right to purchase Playoff Tickets for games occurring prior to the effective date of termination.
- ALL SALES ARE FINAL: Except as expressly provided herein, all sales are final and no refunds or exchanges will be given. Payments must be made on or before the agreed-upon payment plan dates. The Tickets shall be delivered to You electronically before the first match of the USL Championship season (the “League” that Atlético participates in and holds rights for), but only if Your Atlético account is in good standing; otherwise the Tickets will not be delivered to You until You have paid Your Membership dues in full. If You are on an installment payment plan and You fail to make any such payments when due, Atlético may, after 10 days’ notice and opportunity to cure, either (i) withhold the Tickets from You for upcoming events until full payment is made and Your Membership account is in good standing; or (ii) terminate Your Membership, with any payments made by You prior to the termination date forfeited by You. If the amount that You pay for a Ticket is obviously incorrect due to a bona fide error, regardless of whether in error in a price posted on this platform or otherwise communicated to You, or You are able to order Tickets before their scheduled on-sale date, then we reserve the right, at our sole discretion, to cancel Your order and refund to You the amount that You paid. This policy will apply regardless of how the error occurred. In the event of cancellation of an Event, Atlético shall not be required to issue a refund provided that You are given the right, within twelve months of the date of the original Event, to attend a rescheduled performance of the same Event or to exchange Your Ticket for a comparable ticket to another similar event as designated by Atlético. If a rescheduled or comparable event is not offered within twelve months, or if the seat location or quality is materially different, You may elect a refund or account credit. For partial cancellations (such as season curtailment), refunds or credits will be issued on a pro rata basis.
- PLAYOFFS: The cost of playoff Tickets is incremental to Your annual Membership dues. Full-season Members automatically retain their seats for all home playoff games, and full-season Members in good standing will be charged for playoff tickets before completion of each playoff round through the same payment method selected for their Membership dues. Atlético will provide playoff ticket pricing information, including per-round price ranges, by email and posting to Your account. Such full-season Members may provide written notice of their election to decline playoff tickets by the stated deadline date, using an online form or email, and will receive confirmation of opt-out receipt; no charges will be incurred and no change to their Membership status. Non-full-season Members are not guaranteed playoff tickets but will be provided with presale priority based on availability. If You opt-out or otherwise do not re-enroll in Membership for the following season, prior to the playoffs, and would otherwise be eligible to receive the option to purchase playoff tickets, You will receive the option to purchase playoff tickets, but will not receive Membership pricing and must pay for all potential playoff games in advance.
- RESTRICTIONS: You may not transmit, distribute, or sell (or aid in transmitting, distributing, or selling), in any media now or hereafter existing, any description, account (whether text, data, or visual), picture, video, audio, or other forms of exploitation or reproduction of any USL Championship match or surrounding activities (in whole or in part) for which the Tickets are issued to You. The Tickets may not be used by you for any form of commercial or trade purposes, including, but not limited to, the sale by You of all or substantially all (defined as 50% or more) of the Tickets for the USL Championship season (including via Jump) for non-personal, business use (whether or not for profit), or for advertising, promotions, or contests or sweepstakes, without the express prior written consent of Atlético and the USL Championship. Any violation of these restrictions may result in cancellation of the affected Tickets and/or termination of Your Membership, with notice and an opportunity to contest the action.
- ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND INDEMNITY: YOU, AND ANY HOLDER OR USER OF THE TICKETS, VOLUNTARILY ASSUMES ALL RISKS AND DANGERS OF PERSONAL INJURY (INCLUDING DEATH), BALL STRIKES, AND ALL OTHER HAZARDS ARISING FROM OR RELATED IN ANY WAY TO THE EVENT, WHETHER OCCURRING PRIOR TO, DURING, OR AFTER THE EVENT. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU (ON BEHALF OF THEMSELVES AND ANY HOLDER OR USER OF THE TICKETS) HEREBY RELEASE AND WAIVE ANY AND ALL CLAIMS AGAINST THE VENUE, CLUB, EVENT PROMOTER, LEAGUE, AND THEIR RESPECTIVE AFFILIATES, OWNERS, AND REPRESENTATIVES FOR ANY CLAIMS RELATED TO THE EVENT. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS THE VENUE, CLUB, EVENT PROMOTER, LEAGUE, AND THEIR AFFILIATES FROM ANY CLAIMS, DAMAGES, OR LOSSES ARISING FROM YOUR OR YOUR GUESTS’ VIOLATION OF THESE TERMS OR THE CODE OF CONDUCT.
- FAN BEHAVIOR AND CODE OF CONDUCT: If You or any user of the Tickets behave in an unruly or disruptive manner, including, but not limited to, foul or abusive language, intoxication, destruction (or attempted destruction) of Cotton Bowl (“Venue”) property, physical or verbal abuse of other fans, Venue employees, game officials, players, or coaches, or violation of the posted Code of Conduct, You may be asked to leave and/or be ejected from the Venue. You are responsible for such behavior by anyone using the Tickets. In the event of such behavior, Atlético may, in its sole discretion, terminate Your Membership without refund or other compensation, subject to any required notice and appeal or reinstatement process as set forth in the Code of Conduct. Venue reserves the right to revoke and/or eject You, Holder, or User of Tickets without a refund for any violation of Venue, Club, or Event rules, disorderly conduct, or resale or attempted resale of Ticket. Violations by transferees or guests will be deemed violations by You.
- SEARCH UPON VENUE ENTRY: YOU AND YOUR BELONGINGS MAY BE SEARCHED UPON ENTRY INTO THE VENUE. PROHIBITED ITEMS INCLUDE, BUT ARE NOT LIMITED TO, WEAPONS, ILLEGAL SUBSTANCES, OUTSIDE ALCOHOL, AND OTHER ITEMS AS POSTED AT THE VENUE. YOU CONSENT TO SUCH SEARCHES AND HEREBY WAIVE ANY RELATED CLAIMS THAT MIGHT ARISE AGAINST ATLÉTICO OR THE LEAGUE. IF YOU ELECT NOT TO CONSENT TO THESE SEARCHES, YOU WILL BE DENIED ENTRY INTO THE VENUE AND WILL NOT RECEIVE A REFUND FOR THAT EVENT. THIS POLICY APPLIES TO OTHER USERS OF THE TICKETS, WHO ALSO HEREBY WAIVE ANY RELATED CLAIMS THAT MIGHT ARISE AGAINST ATLÉTICO OR THE LEAGUE. YOU AGREE TO COOPERATE WITH LAW ENFORCEMENT AND VENUE SECURITY AS REQUIRED.
- USE OF IMAGE, LIKENESS, AND PUBLICITY RIGHTS: You and other users of the Tickets (“Holder(s)” or “User(s)”) hereby grant Atlético and the League (and their respective designees and agents) a perpetual, worldwide, royalty-free license to use Your/their image, likeness, actions, and statements in any live or recorded audio, video, film or photographic display or other transmission, exhibition, publication or reproduction made of or at the game in any medium, whether now known or hereafter created, for any commercial, promotional, or other lawful purpose, without further authorization or compensation. If a minor uses the Tickets, You represent that they have authority to grant this consent and waive any publicity or moral rights to the extent permitted by law.
- DISCLAIMER: LIGHTS, MUSIC, AND SENSORY ACCOMMODATIONS: Please be advised that with each home team goal a coordinated music & light show will follow. It does contain bright, flashing lights that may cause discomfort and/or seizures for those with photosensitive epilepsy. For those with noise sensitivity, sensory bags are available at Guest Services for our guests’ sensory needs. If You require additional accommodations, please contact Guest Services for assistance.
- WEATHER POLICY AND EVENT DISRUPTION: In the event of severe weather in the vicinity of the Venue, fans should listen for public address announcements, keep an eye on the video board and follow the Club on social media to receive any pertinent updates. Should fans be advised to exit the stadium for shelter due to conditions, re-entry will be allowed once the game is scheduled to resume. Upon a resumption of play, games will restart from where they stopped, preceded by a warmup period. If a game is postponed to a later date, tickets and parking passes from the original date will be honored. Decisions regarding postponement, abandonment, or completion of the Event will be made by the League and Venue in accordance with league rules. If a match is abandoned and not completed, You will receive a credit or refund as set forth in the refund/credit policy. Generally, soccer games go on through rain unless conditions make playing impractical or dangerous.
- ARBITRATION AGREEMENT: To the fullest extent permitted by law, You and Atlético (the “Parties”) agree that any and all disputes, claims, or controversies arising out of or relating in any way to these Ticketing Terms and Conditions, the purchase, transfer, or use of any Tickets, any Membership, admission to or attendance at any Event, or any interactions with Atlético, the Venue, the League, or their respective affiliates and representatives, whether sounding in contract, tort, statute, or otherwise (“Dispute”), shall be submitted to the American Arbitration Association (“AAA”), or its successor, and shall be resolved exclusively by final and binding individual arbitration. Within seven (7) days of the service of the notice of arbitration, the Parties shall mutually agree upon a single arbitrator. If at the conclusion of those seven (7) days, the Parties have not agreed upon a single arbitrator, the Parties shall petition the organization administering the arbitration to provide a list of five (5) qualified arbitrators with experience presiding over claims substantially similar to those pled in the notice of arbitration. Within five (5) days of receiving the list of qualified arbitrators, each Party shall submit to the administering organization a numerical ranking of their preference as between these five (5) arbitrators. The highest mutually ranked arbitrator shall preside over the Dispute. The arbitrator shall have the exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or any part of this arbitration agreement is void or voidable. The arbitrator may award any relief that would otherwise be available in court, subject to the limitations of these Ticketing Terms and Conditions. Each party shall bear its own attorneys’ fees and costs, and shall share equally the arbitrator’s fees and administrative costs, except as otherwise required by applicable law or provided by the selected administrator’s consumer rules. Class, collective, consolidated, representative, or private attorney general proceedings are not permitted, and claims may be brought and arbitrated only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. If a court of competent jurisdiction determines that any waiver in the preceding sentence is unenforceable with respect to any claim, then such claim (and only that claim) must be severed and brought in court, and all remaining claims shall be arbitrated. The seat and exclusive venue for the arbitration shall be Dallas, Texas, and Texas law shall govern the parties’ substantive claims, without regard to its conflict of law rules, consistent with the Federal Arbitration Act’s preemptive effect. Judgment on the arbitrator’s award may be entered in any court having jurisdiction thereof.
- WAIVER OF JURY TRIAL: THE PARTIES KNOWINGLY, VOLUNTARILY, IRREVOCABLY, AND UNCONDITIONALLY WAIVES ANY RIGHT THEY MAY HAVE TO A TRIAL BY JURY IN RESPECT OF ANY LEGAL ACTION ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE TRANSACTIONS CONTEMPLATED HEREBY. EACH PARTY TO THIS AGREEMENT CERTIFIES AND ACKNOWLEDGES THAT (A) NO REPRESENTATIVE OF ANY OTHER PARTY HAS REPRESENTED, EXPRESSLY OR OTHERWISE, THAT SUCH OTHER PARTY WOULD NOT SEEK TO ENFORCE THE FOREGOING WAIVER IN THE EVENT OF A LEGAL ACTION; (B) SUCH PARTY HAS CONSIDERED THE IMPLICATIONS OF THIS WAIVER; (C) SUCH PARTY MAKES THIS WAIVER VOLUNTARILY; AND (D) SUCH PARTY HAS BEEN INDUCED TO ENTER INTO THIS AGREEMENT BY, AMONG OTHER THINGS, THE MUTUAL WAIVERS AND CERTIFICATIONS IN THIS SECTION.
- GOVERNING LAW: This Agreement shall be governed by and construed in accordance with the internal laws of the State of Texas without giving effect to any choice or conflict of law provision or rule.
Recurring Payment Authorization: You understand that by signing this Recurring Payment Authorization, which, collectively with the Terms, shall constitute Your Membership Agreement (this “Agreement”). By accepting or using Tickets, You agree to be bound by the Terms, and in the event of any conflict between the Terms and any other website or platform terms, the Terms shall control for all matters relating to Tickets and Event attendance. I (a) authorize Atlético or Jump to charge my credit/debit card (or withdraw from my bank account via Electronic Funds Transfer, if so selected by me) I provide to my ticket representative for my annual Membership (as defined below) dues for the ticket(s) associated with my Membership account, which collectively with any playoff tickets I purchase under this Agreement are referred to herein as the “Tickets”; and (b) agree to the terms and conditions of this Agreement. I understand that my initial and subsequent installment charges will be made to such an authorized card/account in association with my chosen payment plan until such annual dues are paid in full. I acknowledge and agree that my Membership will automatically renew in June of each successive year, unless either I or Atlético or Jump provide written notice of cancellation, for any reason or no reason, or complete the opt-out form during the renewal period. For all Membership payments, this recurring payment authorization shall remain in effect for so long as my Membership remains in effect. I hereby warrant that I have the authority to charge the credit/debit card (or withdraw from the bank account) I provide to my ticket representative to the listed account to pay my annual Membership dues. I understand and agree that Atlético or Jump will provide a renewal reminder by email and will provide notice of any price changes. I may cancel my Membership at any time prior to the renewal date without penalty by submitting a written cancellation request or completing the opt-out form provided online or by email. I further authorize Atlético or Jump to use card updater services, and agree to pay any NSF or returned ACH fees up to the maximum permitted by Texas law. I agree not to initiate chargebacks except in the case of a bona fide billing error, and that any billing corrections will be made promptly upon notice to Atlético or Jump.
